1. Acceptance of Terms

By registering for or using High Velo Photos (the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Description of Service

High Velo Photos is an AI-powered photo marketplace that enables photographers to upload event photos and uses facial recognition technology to help athletes and their families discover photos they appear in. The Service is operated by Buster66, LLC, doing business as (“d/b/a”) High Velocity Photos, a Florida limited liability company.

3. Facial Recognition and Biometric Data

By registering a face with our Service, you explicitly consent to the collection, storage, and processing of biometric facial data (including facial embeddings and recognition vectors) for the purpose of matching your likeness to event photographs. You acknowledge that:

  • Biometric data is processed using Microsoft Azure AI Face API.
  • The facial embedding for a face you register yourself is stored securely within High Velo Photos infrastructure for matching. Faceprints we compute for faces merely detected in uploaded event photographs (people who did not register themselves) are transient and match-only — held in memory only long enough to match against registered faceprints and then immediately discarded, never stored.
  • You may request deletion of your biometric data at any time by contacting us at privacy@highvelo.com.
  • When registering a face on behalf of a minor, you confirm you are the parent or legal guardian and have authority to provide this consent.

You represent that any individual whose face you register is at least 13 years old, and that you are their parent or legal guardian if they are a minor.

If you upload photographs to the Service, you further represent and warrant that you have obtained all notices, consents, and releases required by applicable law — including the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), and Washington RCW 19.375 — from every individual whose biometric identifiers (such as a facial-recognition faceprint) may be derived from those photographs, or that an appropriate event or venue notice was provided. You understand the Service computes a numerical faceprint for faces detected in uploaded photos in order to match them to event photographs, and that for faces that were not registered by their owner this faceprint is transient and match-only — computed in memory, used for matching, and immediately discarded rather than stored. You agree to indemnify, defend, and hold harmless Buster66, LLC d/b/a High Velocity Photos against any claims, damages, or liabilities arising from your failure to obtain the notices, consents, or releases required for the people who appear in the photographs you upload.

4. Photo Content and Copyright

Photographers uploading photos to the Service retain copyright to their work. By uploading, you grant Buster66, LLC d/b/a High Velocity Photos a limited, non-exclusive license to display and process those photos within the Service. Unauthorized downloading, redistribution, or reproduction of photos is strictly prohibited.

5. User Accounts and Eligibility

You must be at least 13 years of age to create an account. By registering, you represent that all information provided is accurate. You are responsible for maintaining the security of your account credentials.

6. Purchases and Payments

Photo packages are sold by individual photographers. All sales are final unless a package is found to be materially different from its description. Buster66, LLC d/b/a High Velocity Photos acts as a marketplace and is not responsible for disputes between buyers and photographers.

7. Privacy and Communications

Your use of the Service is also governed by our Privacy Policy. We use SendGrid to send transactional emails, Twilio to send SMS, and Azure services for all data storage and processing. We do not sell your personal information.

Notifications are organized into three categories — system messages (sign-in codes and MFA, governed by your sign-in method and not opt-outable), activity alerts (photo matches, forum replies, purchase confirmations), and marketing (promotions and product updates). Activity and marketing are each independently controllable per channel (email and SMS) from your Notification Preferences page. SMS opt-in is captured separately under the Telephone Consumer Protection Act (TCPA), and marketing opt-in is captured separately under the CAN-SPAM Act — revoking one does not affect the other.

8. Limitation of Liability

To the maximum extent permitted by law, Buster66, LLC d/b/a High Velocity Photos shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. The Service is provided “as is” without warranties of any kind.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.

10. Google Photos & Third-Party API Use

When you connect your Google Photos account from the Account Storage page, our use of the photos you select through the Google Photos Picker API is subject to Google’s API Services User Data Policy, including the Limited Use requirements.

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
